Cultivate’s Terms of service
Opening hours:
We are open to the public based on our classes & event times and for periods in the afternoons when we sell readymade food. Please see our timetable for individual class times.
Our space may be closed periodically for holidays or vacation time. These times will be updated on our Google Business profile and on our social media profiles.
Terms & Conditions:
The following terms and conditions have been prepared to help you make the most of Cultivate’s services. These terms and conditions, constitute the entire agreement between you and us in relation to the services we provide when you are using our services and/or our space, attending our classes, workshops and events and visiting our website, including any external event in which Cultivate participates.
In these terms and conditions the following definitions apply:
‘Cultivate’, ‘We’ or ‘Us’ means Cultivate.
‘Member’ or 'You' means someone who has completed our registration form electronically through our website or at our location.
‘Activity’ means a class, workshop or event (this includes meals) provided by Cultivate.
‘Space’ means the location at which the activity occurs as indicated by Cultivate.
By agreeing to our terms and conditions you are granted a personal, limited privilege to enter and use our space, website and equipment without prejudice to our other rights with immediate effect if you agree with the above. Please do not use any of these services if you disagree with any of our terms.
Class participation:
Before taking part in any class at Cultivate a registration form and waiver must be completed online.
Your registration information is held by our third party software supplier - Squarespace.
By completing the Cultivate registration online using our website you are applying to become a customer of Cultivate and accept these terms and conditions.
Acceptance of a customer is at the sole discretion of Cultivate.
A person will cease to be a customer if their rights are terminated under these terms and conditions.
Cultivate reserves the right to expel anyone from the premises, terminate a customer relationship for anyone who fails to comply with these terms and conditions.
Activity booking:
Activities can, subject to availability and your eligibility to book, be booked online until 1 hour before the activity begins.
All activities must be paid for in advance.
Cancellation of your activity booking:
If you are unable to attend an activity, we will provide you a full refund as long as you give us 12 hours notice of your non attendance. Cancellations must be made through the website.
If you book online and don’t turn up for any reason, the cost for that activity will not be refunded.
We reserve the right to cancel activities. We will do our best to let you know about the cancellation as soon as possible. If an activity is cancelled you will be issued a refund. Refunds may take up to a week to process, depending on our third-party payment processor, Stripe.
Health and Safety:
Exercise: You acknowledge that you are fully aware that the participation in classes or workshops involves risks and that you accept all the risks of participating.
You affirm that you are in proper physical condition to participate in any activity associated with Cultivate, its classes and equipment, and are aware that there are risks for you and/or your children in participating in any physical activity, potentially which could result in injury, serious injury or death.
You are aware that it is advised to consult a physician prior to participating in or using our physical services. If you suffer from any health problems, are undergoing any medical treatment or are taking medication, you must consult your medical practitioner before starting an activity that may compromise your health. Wellness activities at Cultivate should not be considered a replacement for professional medical counseling or treatment.
You agree to declare all injuries, illness, pregnancy and medication to the teacher before any activity.
Exercise should be performed at a pace which feels comfortable to you. Pain is the body's warning system and should not be ignored. You must take responsibility for your own body during any physical activities in our space, and must inform the instructor immediately if you feel any discomfort. If you are in any doubt as to which activities are suitable, then you must consult with the teacher before you proceed. You must stop exercising immediately if you notice any detrimental physical effects. You confirm that in this case, you will seek the advice of a suitably qualified health professional and will not continue to use any of our Services unless that health care professional has advised you that you are fit and able to do so.
Food: We always aim to use the freshest ingredients, sourcing from local farms and trusted suppliers. However, since we're working with natural, seasonal produce, and wild fish and grass-fed meat, there may be some risks—especially when it comes to allergies or cross-contamination. Please let your server know about any allergies or dietary restrictions before ordering, and we'll do our best to accommodate you. While we take precautions, we can't be held responsible for any allergic reactions or health issues that may arise, including those caused by our suppliers.
Limitations of Liability:
Cultivate, nor its employees or agents shall be responsible for any loss, damage or theft of property, including bicycles or strollers left outside of the space by you or your guest.
All property parked or locked outside of our premises are left at the owner’s risk and Cultivate cannot be held responsible.
Cultivate does not accept liability for any loss or damage of personal items on its premises.
Cultivate cannot be held responsible or liable for any personal injury, illness or, in the worst circumstance death which happens on our premises or as a result of our facilities or services provided.
Without prejudice to the conditions set out under our Health and Safety terms, it is your responsibility to ensure you are in the appropriate physical and mental condition to participate in our activities or operate our kitchen equipment. If in doubt, it is your responsibility to ask a member of staff for help.
We do not accept any liability in connection with any third party websites which may be linked or accessible through our own site, and we do not approve or endorse the content of such sites.
Privacy:
We take your privacy seriously and are committed to protecting your personal data to the best of our ability. We use trusted third-party services like Squarespace, Acuity, and Stripe to process bookings, payments, and communications, and while we carefully select these platforms for their security measures, we cannot be held responsible for any breaches that may occur through these services. By using our site or services, you acknowledge and accept that your data may be handled by these third parties, and we recommend reviewing their privacy policies to understand how your information is protected. Rest assured, we will always do our best to ensure your information is kept safe and secure.
